ISLAMABAD: Another move to ban child marriages in Pakistan has fallen at the first hurdle. The bill to prohibit underage marriages has been withdrawn after the Council of Islamic Ideology (CII) declared it un-Islamic.

The ruling party lawmaker, who moved the bill, withdrew her proposal on Thursday following staunch resistance from the council, which advises the legislature whether or not a certain law is Sharia-compliant.

The National Assembly’s Standing Committee on Religious Affairs and Interfaith Harmony rejected the Child Marriage Restraint (Amendment) Bill 2014 after the CII dubbed it ‘anti-Islamic’ and ‘blasphemous’.

The committee meeting, which was presided over by its Chairman Hafiz Abdul Karim, unanimously rejected the bill on ‘purely religious grounds’. Afterwards, PML-N’s Marvi Memon also withdrew her proposal.

The proposed legislation had recommended harsher punishments for those entering conjugal contracts with minors.

Last week, lawmakers in the Gilgit-Baltistan Assembly had also blocked a bill seeking ban on child marriages over similar concerns.

The CII has already ruled the minimum age stipulated for marriage in the Child Marriages Restriction Act of 1929 does not comply with Islamic laws.

In May 2014, amid severe criticism from various quarters, the council had endorsed its earlier ruling that girls as young as nine years old were eligible to be married “if the signs of puberty are visible”.

About two years ago, CII Chairman Mohammad Khan Sheerani told the National Assembly that the council had given its recommendations over the suggested law and this should not have been discussed anymore.

He made these comments after Marvi had introduced the bill seeking amendments in the marriage act. The bill was then backed by MNAs Asiya Naz Tanoli, Muhammad Pervaiz Malik and Shaista Pervaiz.

Sheerani had opposed the proposed amendments, saying they were contrary to Islamic teachings and laws.

“Parliament cannot create legislation that is against the teachings of the Holy Quran or Sunnah,” he had said while backing his arguments with relevant laws and a few references from the Holy Quran and Hadith.

According to Islamic laws, marriage can be solemnised when a girl attains puberty, Sheerani claimed. Under the Constitution, the CII chairman is the final authority in the council with the choice to overrule the voice of all members. While the CII’s decisions are not binding on parliament, they are treated as the guiding principles to frame laws.

Thailand is also quite lax in its treatment of daughters.  Prostitution of nubile girls is a frequent income generator for parents, so I hear.

I actually just read a short article a few days ago about the sex trade (though it was more about the Trans prostitutes it covered the whole trade in general) in Thailand... from what I have read it is something that from birth they are "groomed" into becoming if they were born to a poor Thai family. The money to be made from it is just too good. Legal or not young girls far bellow 17 are being exploited at very high rates.

The illusion created here is that even if it was banned, it wouldn't solve the problem.

Making laws do not do jack, if there isn't a real powerful state and institutions to enforce them. It has always been prohibited in Turkiye and there are 181. 000 marriages of the sort.

As far as my knowledge goes, the government has been trying to stop this bs for a while. came in the news many times that 9 year old was being married off or some thing like that. the police would try arrest everyone including the Imam.

Underage marriage has happened in certain parts of the US as well, particularly the more backward parts.  As I understand it from someone in the know, if you can transfer a pre-teen girl from her father to her husband ... to make some continuity ... she remains a child in her mind, she is much less likely to develop an independent streak.  She never gets the opportunity for teen-age rebellion.  I think we can see this today in Mormon polygamous families like in W Texas.

As I also understand it, prior to 1950, there was no teen-age culture anyway, this was created by the children who came from broken homes from the 1930s to 1940s, became parents in the 1950s, and child labor prohibition was enforced after WW II.  In short, sock hopping duck tail teens were a recent invention.  Before that children were free labor at home, in the fields, and in the factories.

Yemen is also struggling with under age marriages, but with the Saudi invasion, they have bigger fish to fry.

Nobody mentions Cambodia. They have as much or more of a sex trade for minors as any country. And the practice there is for wealthy men to have both wives and mistresses, so women are devalued from the outset. There is much the same attitude as with Islamic countries towards women in general. And it is a widespread practice to put up a girl's virginity for bidding.
