Poor corporate America. I worked for State Farm Insurance Co. for a few years, the pyramid was quite well in place there. BUT it was nothing compared to the military. Some how, during my twenty years on active duty, I avoided a court-martial for "disrespect". Liked to skate on the edge of actually calling some officer an idiot.

Imho, fan fiction is always a combination of two things: 1) an addition to already existing characters/setting 2) amateur (which implies non-commercial)

So no, most of those examples are not actually fan fiction.  Writers can and always have been using ripping each other off and/or inspiring each other (the difference between the two is largely a matter for the courts to decide)

Even stuff directly referencing other works isn't fan fiction if the characters/setting are unique or if the writer is a professional and getting paid for it.

So, the Stephen Baxter audiobook that I just finished listening to, The Time Ships, isn't a fan fiction of H. G. Wells's The Time Machine? Makes sense to me. It's way too good to be considered fan fiction.
